June 6, 2013-Houston, Texas. A jury returned a verdict for a Florida based insurer late Friday afternoon following a trial in the 133rd Judicial District Court of Harris County, Texas. The defense verdict followed three days of testimony wherein two policyholders alleged the insurer committed acts of fraud, a breach of the duty of good faith and fair dealing, and other breaches of the Texas Insurance Code. The plaintiffs sought to treble their damages by further asserting that the alleged violations were committed knowingly.
The jury of twelve persons consisted of a wide variety of Harris County voters who found no such breaches were committed. Conversations with the jurors following the verdict indicated they did not agree with the assertions by the plaintiffs and their expert witnesses that the insurer failed to properly assess the loss and the resulting damages nor their claims that the insurer breached any of the policy or Texas Insurance Code.
